Tomato companies dispute $500,000

A Birmingham, Ala., produce wholesaler filed suit in federal court for almost $500,000, it claims Atlanta Tomato LLC owes for shipments beginning in July 2009 through Jan. 6 this year.

Flavor-Pic Tomato Inc., Birmingham, filed the suit in the Northern District of federal court in Birmingham in late May. It provided the court with copies of 77 invoices, ranging from $21 to more than $22,000, for produce it provided to Atlanta Tomato, Forest Park, Ga.

The total due, according to court documents, is $492,898. Flavor-Pic also wants 18% interest and all of its legal fees paid by Atlanta Tomato.

The lawsuit lists Tim Adams as the principal manager for Atlanta Tomato and seeks to hold him personally liable for the debts if the company does not pay.

According to its website, Flavor-Pic is a family owned company with 40 years of experience in tomato sales. It also handles a variety of other fresh produce commodities.
