Texas shipper indicted for fraud, money laundering

Progreso Produce LimitedCurtis DeBerry, owner of Progreso Produce Ltd., has been indicted on nine counts including wire fraud, money laundering, falsified statements to a financial institution and false declarations in bankruptcy proceedings.

A grand jury in the U.S. District Court for the Western District in San Antonio handed down the indictment July 9. DeBerry, 53, was arrested in June and released on $50,000 bond. An arraignment is scheduled for July 22.

Progreso Produce filed for Chapter 7 liquidation in the fall. Before the filing, the indictment alleges DeBerry lied about deals with Mexican strawberry growers and Raleigh, N.C.-based L&M Cos. to bring in financing and lure in a potential buyer for the failing company.

Progreso Produce was started by DeBerry’s father Dale DeBerry more than 40 years ago.

Curtis DeBerry bought the company and the elder DeBerry remained in a sales role. Curtis DeBerry is the sole defendant in the indictment.

The indictment also alleges DeBerry falsified accounts receivable to secure about $7 million in refinancing, and lied to a potential buyer of the company, pitting the buyer against a nonexistent counteroffer to secure a $500,000 downpayment.

DeBerry could face jail time if convicted, with felony counts punishable up to 30 years, plus fines. He also is facing a civil suit related to the failed buyout.

What an embarrassment to his family and the whole produce industry. We all must answer for ourselves in the end and I sure hope he has a better answer than " I don't care" when standing in front of his creator.. Good luck in Prison

I know this dude and his con artist ways. He's been doing these kind of scams for years and years. Always looking for another mark with no sympathy for who he hurts or destroyed. I hope for once, he get's his due. Don't waste your sympathy on this crook.

I agree with ralph and locknloadz. Karma has been waiting for him for some time. Judgment was in on him a long time ago. It is sad because we all know how many people he hurt, and that can't be fixed.

Nairb, I don't know what planet you're from, but his creator is God in this instance. I hope people can see his whole family isn't like him. They are some of the best people you could meet.

I think probably everyone on this page has a very legitimate answer but I personnaly know the man and the family and have for over 35 years the one and only thing that I have to respond on this is that Curtis DeBerry and his wife are solely responsible for his actions now and for the last 15 years not his Father, Mother, or Son as I have known them for some time and dealt with his Dad for over 35 years I can truthfully tell you that they had nothing to do do with this or any other scam unfortunately I cannot say the same for Curtis and his wife I would hope that the produce industry can and will make the distinction here. I have never known or dealt with better people than his Dad Mom and Son and what I have stated is not from hear say but from personal knowledge on a every day basis. I wish to thank everyone for letting me and reading my response.
