Businesses sanctioned for PACA violations

Five produce businesses have been restricted by the U.S. Department of Agriculture from operating in the industry for failure to pay reparation awards issued under the Perishable Agricultural Commodities Act.

The following businesses and individuals are currently restricted from operating in the produce industry, according to a USDA news release:

  • Haven Packing & Cold Storage LLC, Tulare, Calif., for failing to pay a $23,106 award in favor of a California seller. Paul Hertzler, Cesar Mora, and Rigoberto Rios were listed as members of the business.
  • Reed Saul Inc., White Oak, Pa., for failing to pay a $3,557 award in favor of a California seller. David Golomb was listed as the officer, director and major stockholder of the business.
  • Castalyny Cerbeses Inc., Santa Ana, Calif., for failing to pay a $12,840 award in favor of a Texas seller. Charles Wallace Sr. was listed as the officer, director and major stockholder of the business.
  • JJ 99 Produce Inc., Rio Rico, Ariz., for failing to pay a $33,457 award in favor of an Arizona seller. Jose Santana was listed as the officer, director and major stockholder of the business.
  • Pier 27 South LLC, Northbrook, Ill., for failing to pay a $309,029 award in favor of a Georgia seller. 2062621 Ontario Inc., Rob Griffore, Dan Hall, and Steven Kaiser were listed as members of the business.

Surety Bond Posting

Farm Fresh Packers LLC, Deerfield Beach, Fla., has posted a $110,000 cash surety bond in accordance with PACA regulations.

The bond was posted with the USDA to employ Jeff Pfaff, the only officer of Top Tomato Company, Pompano Beach, Fla., which was found to have committed PACA violations.

USDA will hold the $110,000 bond for four years, giving the industry assurance that the company will be able to conduct its business according to PACA rules.
