USDA restricts Paganini Produce exec

The U.S. Department of Agriculture has re-imposed employment restrictions on Celso Paganini after the dismissal of a suit Paganini filed in the U.S. District Court for the Southern District of New York.

The case was dismissed in December 2012.

The USDA previously found Paganini responsibly connected after Paganini Produce LLC failed to pay an $83,290 award to a California receiver, a violation of the Perishable Agricultural Commodities Act.

Paganini Foods LLC, Swedesboro, N.J., and Celso Paganini are now restricted from operating in the produce industry.

Let's be more precise. Actually the award is for legal fees that Westlake Produce incurred defending itself from Paganini Foods LLC. In 2007 during the California citrus freeze Westlake ordered 150 containers of Sicilian oranges from Paganini and never took delivery of them. As a result of the ruthless actions of Westlake Produce, Paganini Foods has been put out of business. In addition the PACA administrative judge in the resulting PACA lawsuit did a very poor job, and justice has not been made. The key witness for Paganini Foods, Tip Murphy, who drafted the agreement between the companies, died in July 2008, shortly before the PACA hearing.

The long arm of the Government, it all depends on whose campaign you donate to. Donate to a Republican, end up with ICE and labor investigations. Donate to a Democrat, receive favorable Judgements from Government Agencies.
