USDA initiates PACA action against bankrupt firm

The U.S. Department of Agriculture is taking administrative action against T&R Produce Wholesale & Trucking Inc., Sanford, Fla., in relation to more than $260,000 in unpaid fresh produce bills.

The company failed to pay four produce sellers from June 2010 through December 2011, according to a notice on the USDA website.

T&R Produce Wholesale & Trucking Inc. will have an opportunity to request a hearing under the Perishable Agricultural Commodities Act. Should USDA find that the company committed repeated and flagrant violations, it would be barred from the produce industry for two years.

T&R principals could not be employed by or affiliated with any PACA licensee for one year and then only with the posting of a USDA-approved surety bond.

The company filed for Chapter 7 bankruptcy in August 2012, reporting assets of $1 million and liabilities of $1.4 million. The bankrputcy trustee on the case filed the final report July 12, effectively closing the case.
