Cry Baby Foods LLC, Royal City, Wash., has satisfied a reparation order issued under the Perishable Agricultural Commodities Act, according to a U.S. Department of Agriculture news release.

USDA sanctioned the company in August 2014 for failing to pay a $245,045 award in favor of a North Dakota seller.

Court documents available on the internet indicate Four Star Ag, an onion grower-shipper in Oakes, N.D., filed a case in July 2017 against Cry Baby Foods and its owners in the Washington Eastern District Court. Four Star Ag filed a stipulation of dismissal in the case in December, at which time the judge ordered the case dismissed.

Now that Cry Baby Foods has paid the reparation order, the company can continue operating in the produce industry once it gets a PACA license. Kelsee Shearer and Aaron Shearer were listed as members of the business and are now free to be employed by any PACA licensee.
