The U.S. Department of Agriculture has cited K&A Produce, Staten Island, N.Y., for failing to pay for just under $200,000 to produce sellers.

The citation comes after the USDA filed an adminstrative complaint under the Perishable Agricultural Commodities Act in April for K&A Produce’s failure to pay $199,937 to eight sellers for 48 lots of produce which were purchased, received and accepted in interstate commerce from November 2014 through July 2015, according to a news release.

As a result of its PACA violations, K&A Produce is barred from operating in the produce industry until Sept. 1, 2019, when it can reapply for a PACA license.

The company’s principals, Rodin Diaz and Kevin Diaz, may not be employed by or affiliated with any PACA licensee until Sept. 1, 2018, and then only with the posting of a USDA-approved surety bond.
