USDA files PACA administrative complaints
The U.S. Department of Agriculture has filed administrative complaints under the Perishable Agricultural Commodities Act against a New York individual and company for violating PACA employment restrictions, according to USDA news releases.
The USDA filed a complaint against Yuqing Wang, alleging that Wang was unlawfully employed by a PACA licensee during the period of his PACA employment restrictions.
Yuqing Wang will have an opportunity to request a hearing. Should USDA find that Wang violated the PACA by being unlawfully employed during the period of his PACA employment restrictions, Wang's employment restrictions would be extended for a one-year period.
The USDA has also filed a complaint against Hop Hing Produces Inc., New York, alleging unlawful employment of an individual under PACA employment restrictions after being given notice by USDA that the company was not permitted to employ the individual without USDA approval and the posting of a surety bond.
Hop Hing Produces Inc. also has an opportunity to request a hearing. Should USDA find that the company willfully violated the PACA by unlawfully employing an individual under PACA employment restrictions, it could be barred from the produce industry for two years. Furthermore, its principals could not be employed by or affiliated with any PACA licensee for one year and then only with the posting of a USDA-approved surety bond.
