Southern Sun faces $750K PACA complaint

The U.S. Department of Agriculture has filed an administrative complaint against Southern Sun LLC, Swedesboro, N.J., alleging it failed to pay almost $750,000 owed to produce sellers.

The complaint alleges the company owes $744,685 to 14 produce sellers for product received from February 2018 to November 2018, according to a news release.

The company can request a hearing. If the USDA find Southern Sun “committed repeated and flagrant violations” of PACA law, it would be barred from the industry for three years, or two if the USDA accepts a surety bond.

Likewise, company principals could be banned from being employed by or affiliated with a PACA licensed company for two years, or one year with a USDA-approved surety bond, according to the release.
