USDA files PACA complaint on Poblano Fresh Produce

The U.S. Department of Agriculture has filed an administrative complaint against Poblano Fresh Produce Corp. for allegedly violating the Perishable Agricultural Commodities Act.

Poblano Fresh, a Los Angeles produce wholesaler, failed to pay a produce seller for almost $231,000 from October through November 2019, according to a news release.

Poblano Fresh can request a hearing on the allegation. If the USDA finds the company violated the PACA, it would be barred from having a PACA license for three years, or two years with a USDA-approved surety bond.

Company principals who were “responsibly connected” to the company during the time it received the produce would be barred from employment by or affiliation with a PACA licensee, according to the release.
