Kroger and C&S Resolve Legal Dispute With Settlement

Kroger and C&S Wholesale Grocers have reached a confidential settlement to end litigation over a disputed $125 million termination fee tied to the failed Kroger-Albertsons merger.

The Kroger Co. and C&S Wholesale Grocers, LLC have amicably settled a previously pending litigation between the parties in the Superior Court for the State of Delaware.

All claims have been resolved, according to a news release.

“We are pleased to resolve the claims from C&S, and we look forward to a friendly relationship with them going forward,” says Ron Sargent, chairman and CEO of Kroger. “Kroger remains focused on serving our customers and running great stores across the U.S.”

The terms of the settlement are confidential, according to the release.
