Nicholas Allen barred from industry after PACA ruling

The U.S. Department of Agriculture has found that Nicholas Allen is connected to an Agriculture Commodities Act case involving almost $9.8 million.

The U.S. Department of Agriculture has found that Nicholas Allen is connected to an Agriculture Commodities Act case involving almost $9.8 million.

Allen contested his “responsibly connected” status in the PACA action against Allens Inc., Siloam Springs, Ark. The company failed to pay $9.76 million to 40 produce sellers for 2,312 lots of produce, according to the USDA.

Allen’s appeal of an original USDA decision was dismissed on Feb. 24, according to a news release.
As a result, Allen may not be employed by or affiliated with a PACA licensee until Feb. 24, 2021, and only then with a USDA-approved surety bond.
