USDA filed PACA complaint against Martinez Fresh Produce

The U.S. Department of Agriculture has filed an administrative complaint against Martinez Fresh Produce, Dallas, for alleged Perishable Agricultural Commodities Act violations.

The U.S. Department of Agriculture has filed an administrative complaint against Martinez Fresh Produce, Dallas, for alleged Perishable Agricultural Commodities Act violations.

The company allegedly failed to pay eight produce sellers a total of $155,508 from April 2017 through March 2019, according to a USDA news release.
Martinez Fresh can request a hearing. If the USDA finds the company violated the PACA, it would be barred from the produce industry for three years, or two years with an approved surety bond.

The company’s principals can also be barred from being employed by or affiliated with a PACA licensee for two years, or one year with a USDA-approved surety bond.
