USDA files PACA complaint against Bain Distributors

The U.S. Department of Agriculture has filed an administrative complaint against Bain Distributors Inc. for violating the Perishable Agricultural Commodities Act.

The U.S. Department of Agriculture has filed an administrative complaint against Bain Distributors Inc. for violating the Perishable Agricultural Commodities Act.

Bain Distributors Inc., Santa Fe Springs, Calif., allegedly owes nine produce distributors $557,099, according to a USDA news release. Officials of Bain Distributors, which has ceased operations, can request a hearing to dispute the PACA violations.

The USDA is pursuing PACA sanctions against the company and its officials. If “repeated and flagrant violations” are found by the USDA, Bain Distributors can be barred from obtaining a PACA license for three years; two years if the USDA approves a surety bond. The company’s officials could also be barred from employment by or affiliation for two years, or one year with a surety bond, according to the release.
