PACA claims against frozen food company top $6 million

The U.S. Department of Agriculture has filed an administrative complaint against Imperial Frozen Foods Op Co. LLC for alleged Perishable Agricultural Commodities Act violations totaling $6.3 million.

The U.S. Department of Agriculture has filed an administrative complaint against Imperial Frozen Foods Op Co. LLC for alleged Perishable Agricultural Commodities Act violations totaling $6.3 million.

Imperial Frozen Foods, Wake Forest, N.C., faced a similar $2.2 million complaint, but that case was closed two years ago after the company agreed to pay the 22 sellers in that PACA case, as well as a $40,000 civil penalty.

In the new complaint, the USDA alleges Imperial Frozen Foods owes 31 produce sellers $6.37 million for product from May 2019 to January 2020.

The company can lose its PACA license for up to three years, or two years with USDA approval, if the USDA finds that it violated the PACA.
