USDA files PACA complaint against California firm

The U.S. Department of Agriculture said Nov. 27 has filed an administrative complaint under the Perishable Agricultural Commodities Act against California-based Custom Fresh Cuts Inc.

The U.S. Department of Agriculture said Nov. 27 has filed an administrative complaint under the Perishable Agricultural Commodities Act against California-based Custom Fresh Cuts Inc.

The USDA said the company allegedly failed to make payment promptly to 10 produce sellers in the amount of $696,769 from November 2017 through June 2018.

The agency said Custom Fresh Cuts Inc. will have an opportunity to request a hearing about the complaint.

In the event the USDA finds that the company committed repeated and flagrant violations, the agency said Custom Fresh Cuts Inc. would be barred from the produce industry as a licensee for three years, or two years with the posting of a USDA-approved surety bond. In addition, its principals could not be employed by or affiliated with any PACA licensee for two years, or one year with the posting of a USDA-approved surety bond.
