The U.S. Department of Agriculture has filed an administrative complaint alleging Florida Cool Cargo Inc., Miami, has violated the Perishable Agricultural Commodities Act.

Florida Cool Cargo allegedly failed to pay five produce sellers $115,806 from May to July 2019, according to a USDA-Agricultural Marketing Service news release.

The company can request a hearing. If the USDA finds Florida Cool Cargo violated the PACA, it can bar the company from operating in the industry for three years, or two years with a USDA-approved surety bond.

The company’s principals can be prohibited from being employed by or affiliated with a PACA licensee, for up to two years, or one year with a surety bond approved by the USDA, according to the release.
