USDA files PACA complaint against Fresh Produce Inc.

The U.S. Department of Agriculture has filed an administrative complaint against Fresh Produce Inc. for alleged Perishable Agricultural Commodities Act violations resulting in almost $375,000 in unpaid bills.

The Dallas wholesaler failed to pay $374,069 to 15 produce sellers from May 2018 to August 2019, according to a news release.

Fresh Produce Inc. can request a hearing. If the USDA decides the company has violated PACA regulations, it will be barred from the industry for three years, or two with the posting of a USDA-approved surety bond. Company principals would be barred from being employed by or affiliated with a PACA licensee for two years, or one year with a surety bond, according to the release.
